In India legal notice is considered to be the first step involved in legal proceedings.
Format of Legal Notice.
- Name and address of the sender.
- Mention the subject of the notice.
- Cause of action
- Description
- The relief claimed by the sender
- Legal reasoning for making the claim
- Attach the place of residence/ address of the other party.
- Stamp and signature of advocate sending the notice on behalf of the sender.
Documents required.
- Name, description, and place of residence of the sender of the notice.
- Clear and understanding facts and grievances, reduced in writing.
- Relief or Action claimed, reduced in writing.
- Statement of the cause of action.
- Signed and attested by a registered Advocate.
Conclusion- A legal notice can be sent by email as well but it is advisable to send it by a registered post to keep an otherwise track of the notice. It is not mandatory to reply to legal notice by yourself but it is advisable to do so under the supervision of a lawyer or advocate.
